AUTHORIZATION

In accordance with Article 9 of Law N°2019/013 of July 19, 2019 on the general framework for radiological and nuclear safety, nuclear security, civil liability and the application of safeguards, the exercise of an activity or practice or the construction of a facility involving sources of ionizing radiation unless he or she has obtained prior authorization issued by the authority responsible for regulation and regulatory control. The authorization process begins with notification.

Notification is a document submitted by a natural or legal person to the authority responsible for regulation and regulatory control, notifying its intention to carry out a practice or undertake any other activity involving sources of ionizing radiation.

The different forms of authorization :

Authorization may take the form of registration, license or approval.

Registration is issued for activities and practices involving only low or moderate exposure risks; 

Licenses are issued for activities and practices involving high exposure risks; 

Approval is issued to natural or legal persons possessing skills specific to the exercise of a profession within the scope of an authorized activity or practice.

What is an authorization?

Title issued by the authority responsible for regulation and regulatory control to a natural or legal person, allowing it to undertake activities or practices involving ionizing radiation sources.

Validity of an authorization

 The period of validity of an authorization varies from one practice to another.

Authorized practices :

Medical Facilities

  • Radiotherapy
  • Nuclear medicine  
  • Radiodiagnostics
  • Industrial radiography 
  • Logging 
  • Nuclear gauges for thickness density and level measurement
  • Port inspection with high-energy X-ray generator

Penalties for unauthorized use of ionizing radiation sources

In accordance with article 105 (1) of law N°2019/012 of July 19, 2019 on the general framework of radiological and nuclear safety, nuclear security, civil liability and the application of safeguards, is punishable by five (05) to ten (10) years imprisonment and a fine of two million (2,000,000) to twenty million (20,000,000) CFA francs who

  • Continues to carry out the activity or practice in violation of a suspension or withdrawal of authorization;
  • Engages in any of the activities or practices referred to in article 2 of the said law without authorization.
